1 The Promoter

1.1 The Promoter is D&B Cars Ltd (“The Promoter”). Registered in England and Wales number 12427285. 23 Tir Y Farchnad, Swansea SA4 3GS (“Registered Address”).

1.2 The Promoter’s website: www.winnicecars.co.uk (“The Website”).

1.3 The Promoter’s Facebook page: www.facebook.com/Win-Nice-Cars-100882758130622 (“The Facebook Page”). Facebook does not run, own, or endorse this competition.

1.4 Win Nice Cars and winnicecars.co.uk are trading names of the Promoter.

2 The Prize Competition

2.1 The Promoter is the operator of a prize competitions based website through which entrants can submit their answers to skill and knowledge based questions for an opportunity to win prizes

2.2 Each competition and prize is detailed on the The Website, including the specific competition details (“Competition Details”).

2.3 Each competition will allow a maximum number of entries as specified in the Competition Details (“Maximum Entries”).

3 Competition Entry

3.1 The competition will run from the start date listed in the Competition Details (“Start Date“) and can accept entries until the date and time specified in the Competition Details, or until the Maximum Entries has been reached, whichever is sooner (“Closing Date“).

3.2 The Closing Date may be extended by up to 28 days in the event that sufficient entries have not been reached. Entrants will be notified of any extension of time via email and the The Facebook Page.

3.3 All competition entries received after the Closing Date are automatically disqualified.

3.4 Entrants wishing to enter the competition must  submit an answer to a specific skill and knowledge based question as set out in the Competition Details (“Question”).

3.5 In order to enter the competition, the answer to the Question must be submitted either:

3.5.1 through the Website or

3.5.2 via post: If you wish to enter any of our competitions by post then you must send an unenclosed, handwritten postcard via First Class post stating:  which competition you would like to take part in, the answer to the question specific to that particular competition along with your personal details as follows;

  • Full Name
  • Date of Birth,
  • Postal Address
  • Email address
  • One contact number.

3.5.3 Postcards must also contain the correct answer to the question for the competition entered.

3.5.4 Entrants MUST have an active account on our website at the time the postal entries are processed, all details on postcards MUST match the name and address on the account to which they are to be added.

3.5.6 All postal entries must be received before the close of the competition. Any entries that fail to follow the criteria mentioned above will be void as per any Entry received. One postal entry per person, per competition.

3.6 The entrant understands that they must exercise skill, knowledge and judgement to answer the Question correctly.

3.7 Entrants are responsible for ensuring that they have provided accurate contact details when entering the competition. Such contact details will be used to contact the entrant in the event that the entrant has won a prize.

3.8 The entrant acknowledges that their name and town will be published on The Website and/or The Facebook Page if they win a prize.

3.9 The entrant acknowledges that if they win a prize, they may be asked to feature in promotional material published on the The Website and/or The Facebook Page.

3.10 The Promoter does not accept:

3.10.1 responsibility for competition entries that are incomplete, failed, lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of use of The Website, any postal failure, equipment failure, technical malfunction, high internet traffic, systems, satellite, network, server, computer hardware or software failure of any kind;

3.10.2 responsibility for any failure or inability to contact the entrant as a result of incorrect contact information being supplied by the entrant when entering the competition;

3.10.3 any liability for any loss suffered by an entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of The Website; and/or

3.10.4 proof of transmission as proof of receipt of entry to the competition.

3.11 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

4 Entry Fee

4.1 No purchase necessary. Entries made online will be subject to an entry fee as stated in the Competition Details (“Entry Fee”). Entries submitted via post will be free.

4.2 Only entrants who answer the Question correctly will be entered into the draw for the opportunity to win the prize. Entrants who answer the Question incorrectly will not be entered into the draw but will still be charged.

4.3 Payment of the Entry Fee shall be made online in GBP via a third party payment processor (“Payment Processor”). Entrants will be redirected to the Payment Processor’s website to take payment of the Entry Fee in accordance with the Payment Processor’s terms and conditions.

4.4 Entrants acknowledge that answering the Question correctly and making the payment of the Entry Fee does not guarantee in any way that they will win a prize.

4.5 All entries to the competition are final and the Entry Fee shall be non-refundable unless:

4.5.1 The entry has been submitted after the Closing Date;

4.5.2 Or if there has not been enough entries to reach the Maximum Entries and the Promoter, at their discretion, closes the competition.

4.6 The Promoter may run multiple competitions at the same time. Each competition will have a specific prize as specified in the Competition Details.

5 Eligibility

5.1 The competition is only open to all residents in the UK and Ireland aged 18 years or over, except:

5.1.1 the Promoter;

5.1.2 employees of the Promoter or its holding or subsidiary companies;

5.1.3 employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

5.1.4 members of the households of 5.1.1, 5.1.2 and 5.1.3 above.

5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

5.3 The Promoter will not accept competition entries that are:

5.3.1 automatically generated by computer;

5.3.2 completed by third parties or in bulk; or

5.3.3 incomplete.

5.4 Entrants entering the competition via post are limited to one entry per entrant per competition which will be processed each Monday. The entrant’s details must match the details on the entrant’s account on the The Website as outlined in clause 3.5.2.

5.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.

5.6 Competition entries cannot be returned.

5.7 The Promoter reserves the right to cancel the competition at any time. If the competition is cancelled the Promoter will return the Entry Fee to each entrant (either by bank card refund or by cheque and in one combined payment where several Entry Fees have been made). Where the Entry Fee is returned to the entrant, the Promoter shall have no further liability to the Entrant or to any other person.

6 The prize

6.1 The prize will be as detailed in the Competition Details or the Prize Fund in accordance with clause 6.4.

6.2 The Promoter may run multiple competitions at the same time. Each competition will have a specific prize as specified in the Competition Details.

6.3 The Promoter reserves the right to substitute the prize with a cash alternative to the value of the total Entry Fees received less 30% to cover the Promoters administration costs plus any expenses incurred (including but not limited to marketing costs, payment solutions, legal fees and/or website hosting) (the Prize Fund).

6.4 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

6.5 All vehicle prizes will have a valid MOT where applicable, and while basic checks are made on the condition of tyres, brakes and fluids, the Promoter does not guarantee the road worthiness of the vehicle.

6.6 Vehicle mileage may increase slightly to carry out any repairs/servicing, MOT, valeting and delivery to winner.

6.7 The Promoter does not imply or give any warranty or accept any valuation of the prize. it is the responsibility of the winner to make their own checks and arrange transfer of any respective warranty.

6.8 In entering the competition, the entrant acknowledges that prior to entering the competition they have made their own enquiries both legal and otherwise as to the prize.

6.9 The prize is not negotiable or transferable.

7 Winners

7.1 There will be one winner per competition only unless otherwise stated in the Competition Details.

7.2 The winning entrant for each competition will be selected at random using the Google Random Number Generator live on The Facebook Page (“The Draw”).

7.3 The time and date of the competition draw will be advertised on The Facebook Page and/or The Website within 48 hours of the Closing Date (“Draw Date”).

7.4 The decision of the Promoter is final and no correspondence or discussion will be entered into about the result of the competition following the determination of the winner.

7.5 The Promoter will attempt to contact the winner as soon as possible after The Draw, using the telephone number and/or email address provided on the entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

8 Claiming the prize

8.1 On completion of the competition, the prize will be delivered to the winner as soon as possible, but may take up to 10 working days from the Draw Date.

8.2 Vehicles will be delivered free of charge to the winner’s home address (within the mainland UK) by the Promoter, or logistics partner.

8.3 The winner may collect a vehicle from the Promoter strictly by prior appointment. The Promoter will meet the winner at a local bus/railway station by prior arrangement. 

8.4 Tech prizes will be shipped via courier to the winner’s home address

8.5 Cash prizes will be deposited directly to the winners bank account via BACS transfer. Proof of ID maybe required.

8.6 The Promoter will make all reasonable efforts to contact the winner using the contact details provided on entry. If the winner cannot be contacted or is not available, or has not claimed their prize within 28 days of the Draw Date, the Promoter reserves the right to select an alternative winner in accordance with The Draw set out in clause 7.2.

8.7 The Promoter does not accept any responsibility for entrants who are not able to accept the the prize.

8.8 If the winner resides in Ireland and wishes to import the vehicle, it is the reponsibility of the winner to process all relevant paperwork, and pay all relevant taxes and charges. 9 Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

10 Ownership of competition entries and intellectual property rights

10.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

10.2 By submitting your competition entry and any accompanying material, you agree to:

10.2.1 assign to the Promoter all your intellectual property rights with full title guarantee; and

10.2.2 waive all moral rights in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

10.3 You agree that the Promoter may, but is not required to, make your entry available on The Website, The Facebook Page or other media, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

11 Data protection and publicity

The Promoter will only process your personal information as set out in the Privacy Policy (winnicecars.co.uk/privacy-policy)

12 General

12.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition, and/or any competition.

12.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

12.3 An entry shall be declared void (without any refund being given) if the entrant is found to have been engaging in:

12.3.1 any form of fraud (actual or apparent);

12.3.2 fraudulent misrepresentation;

12.3.3 fraudulent concealment;

12.3.4 hacking or interface with the proper functioning of the The Website; and/or

12.3.5 amending or unauthorised use of any of the code that constitutes The Website.

12.4 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

12.5 The Promoter reserves the right to amend these terms and conditions at any time, any changes will be immediately published on The Website.
